The case of former Kano State governor Kabiru Ibrahim Gaya, who contested Abdulrahman Kawu Sumaila’s victory in the February 25th Senatorial elections, was dismissed by the National/State House of Assembly Election case Tribunal.
Justice R O Odogo, who delivered the decision in Kano on Monday, said that the petition of the All Progressives Congress Senatorial candidate was not only incompetent, but also unable to discharge the burden of proof.
“We find no merit in this petition and, as such, it is hereby dismissed,” he declared.
“We affirmed the declaration of Abdulrahman Kawu Sumaila of the New Nigeria Peoples Party NPP as the winner of the Kano South Senatorial District election held on February 25th, 2023,” he said.
The tribunal awarded the respondent N200,000.
Meanwhile, the National and State Election Petition Tribunal has overturned the election of another Kano NNPP House of Representatives member, Idris Dankawu.
Dankawu, according to the tribunal, faked the West African School Certificate (WAEC) he used to run for the Kumbotso Federal Constituency election.
Munir Babba Danagudi, the petitioner, claimed that the respondent faked the Secondary School Certificate he presented to gain admission to Nuhu Bamalli Polytechnic in Zaria, Kaduna State.
Justice I.P Chima, who delivered the decision, agreed with the petitioner and declared the respondent’s victory null and void, directing the Independent National Electoral Commission to set aside the Certificate of Return issued to him and declare Munir Babba Danagudi the winner of the Kumbotso Federal Constituency election.
